Intellectual Property Policy
A plain-language statement of who owns what on Indo Mail: you own your content, Indo Mail owns its software, design and brand, how open-source components are used and credited, how feedback is licensed, and how to report intellectual property problems.
1. Overview
Intellectual property (IP) means the things people create with their minds, such as writing, photographs, designs, software and brand names. The law protects them through copyright, trade marks, design rights, patents and confidentiality.
This policy sets out how IP is treated on Indo Mail, the email and productivity service of INDO CHATS PRIVATE LIMITED. It answers the questions we are asked most often: Who owns the things I put in my account? What does Indo Mail own? What may I do with Indo Mail's software and name? What open-source software does Indo Mail use? What happens to suggestions I send? How do I report a problem?
This policy supports our Terms of Service. If the two differ, the Terms of Service prevail. It applies to every part of Indo Mail, including Mail, Drive, Photos, Cloud, Contacts, Files, Maps, Translate, Wallet, Travel, Business Profile and the Ads and Marketing apps.
2. You own your content
Your content stays yours. We do not claim ownership of anything you write, send, upload, store or publish through Indo Mail. This includes your emails and attachments, your Drive files, your Photos albums, the text and images on your Business Profile, your contacts, and the creative material in your ads.
You are responsible for your content. You must own it, or have the permission needed to use it in the way you do. You must not store or share anything that infringes the rights of others. See our Copyright Policy and Trademark Policy for how we deal with complaints.
3. The limited permission you give us
To run Indo Mail for you, we need your permission to handle your content. You give INDO CHATS PRIVATE LIMITED a limited, non-exclusive, worldwide, royalty-free permission to host, store, copy, transmit, display, format and back up your content, only as needed to provide, secure and improve the service for you. For example, we need to be able to deliver your message, make a thumbnail of your photograph, scan an attachment for malware, or keep a backup copy.
This permission is limited in important ways:
- It lasts only as long as your content is on Indo Mail, with a short extra period for backups to cycle out.
- It does not allow us to sell your content, publish it, or give it to anyone else, except to our processors who help us run the service, or where the law requires.
- It does not allow us to read your mail to target ads. Free-plan ads are contextual only and never use mail content or personal data.
- It does not allow us to use your mail to train artificial-intelligence models.
- Where you choose to make content public, such as a public Drive link or a Business Profile, you allow people to view it, and we may display it as you chose.
- It does not transfer ownership of anything.
When you delete content or close your account, the permission ends, as described in the Terms of Service and Privacy Policy, subject to legal retention duties and backups.
4. What Indo Mail owns
INDO CHATS PRIVATE LIMITED and its licensors own all rights in the Indo Mail service, other than your content. This includes:
- The Indo Mail software, source code, databases, interfaces, application programming interfaces, documentation and apps for the web and Android, and the iPhone app build.
- The look and feel of Indo Mail, including layouts, screens, icons, animations, illustrations, written text and videos that we have created.
- The Indo Mail name, logo, app names and domain, which are our brand (see the Trademark Policy).
- Our knowledge, methods, filters, detection rules and anti-abuse systems, which are confidential.
- Any improvements, fixes and new versions of the above.
Nothing in the Terms of Service transfers any of these rights to you, other than the limited right to use the service, described in section 5.
5. What you may do with the service
While you follow the Terms of Service, we give you a personal, non-exclusive, non-transferable, revocable permission to use Indo Mail and its apps for their intended purposes. Business and Enterprise customers may allow their own staff to use the service under the plan they have bought.
- You may not copy, modify, translate or make derivative works of the service, except as the law allows.
- You may not decompile, reverse engineer or try to extract source code, except where the law gives you that right despite this restriction.
- You may not remove or hide copyright, brand or other ownership notices.
- You may not rent, sell, lease or sub-license access to the service, unless we have agreed in writing, for example in a reseller agreement.
- You may not scrape, harvest or copy the service or other people's data by automated means, or use the service to build a competing product.
- You may not use our name, logo or domain except as allowed by the Trademark Policy.
6. Open-source software in Indo Mail
Indo Mail is built with the help of open-source software written by communities of volunteers and companies. We are grateful to them and respect their licences. Open-source software remains the property of its authors, and is used under the licence the authors chose, and not under Indo Mail's own terms. Where an open-source licence gives you rights that conflict with our Terms of Service, the open-source licence prevails for that component only.
The main components and their licences are listed below.
| Component | Use in Indo Mail | Licence |
|---|---|---|
| Noto Sans typeface | The font used to display text in the web and mobile interface, including Indian scripts. It is delivered from our own servers, with no third-party font service. | SIL Open Font Licence 1.1 (OFL 1.1) |
| MapLibre GL JS | Draws interactive maps in the Maps app, with map data from Amazon Location Service in Mumbai. | BSD-3-Clause |
| qrcode-generator | Creates the QR codes for UPI payment-request links in the Wallet app, in the browser. | MIT |
| Node.js and its packages | The runtime and supporting libraries of the Indo Mail server, such as for networking, security and file handling. | Mostly MIT, ISC, BSD and Apache-2.0 licences, as stated by each package |
A full list of packages, versions and licence texts is available on request to legal@indoemail.in. We keep copyright and licence notices that the licences require, and we make the source code of an open-source component available where its licence says we must.
7. What those licences mean in practice
- MIT and ISC are short, permissive licences. They allow use, copying, modification and distribution, provided the copyright and licence notice is kept. They carry no warranty.
- BSD-3-Clause is similar. It also says that the names of the authors and contributors may not be used to promote products made with the software without permission.
- Apache-2.0 is permissive, includes a grant of patent rights from contributors, and requires that notices are kept and that changes to files are marked.
- SIL Open Font Licence 1.1 allows the font to be used, studied, copied, embedded and redistributed, including in commercial products. A modified version may not use the reserved font name, and the font may not be sold on its own.
- Open-source licences do not make Indo Mail itself open source. The Indo Mail code and design that we wrote remain our property.
8. Third-party and licensed material
Some content in Indo Mail comes from outside sources and is used under licence or agreement, for example map data and translation engines provided by our hosting processor, Amazon Web Services. Those rights remain with the owners, and are used only to provide the service. Our Privacy Policy explains how we use these processors.
We do not use third-party scripts, advertising trackers or social-media plug-ins in the Indo Mail website and apps.
9. Feedback and ideas
We welcome your suggestions for improving Indo Mail, and your reports of bugs and problems. If you send us feedback, comments, ideas or proposals about the service ('feedback'), the following applies:
- You are not obliged to send feedback, and we are not obliged to use it.
- Feedback is not confidential, and we do not owe you payment or credit for it.
- You give INDO CHATS PRIVATE LIMITED a perpetual, irrevocable, worldwide, non-exclusive, royalty-free licence to use, copy, modify and build on your feedback, in any way, in Indo Mail and our other products, without owing you anything.
- You keep your own rights in the feedback. This licence does not stop you from using your own ideas, but you may not claim that we have promised to treat them as secret.
- Please do not include anything in feedback that is confidential, or that belongs to another person or employer.
Security reports are handled differently. If you find a weakness in Indo Mail, please tell security@indoemail.in and give us reasonable time to fix it before you make it public.
10. Customer content on business and advertising products
If you use Business Profile, Ads, Ad Manager, Merchant Center or similar apps, you give us permission to show your names, logos, pictures, text and offers to the people who see your listings and ads, and to make technical changes such as resizing so they display properly. You promise that you have the right to give this permission, and that your material does not infringe anyone's rights. Where we reject an ad or a listing because of an IP complaint, our Trademark Policy, Copyright Policy and Advertising Policies apply.
11. Reporting an intellectual property problem
If you believe something on Indo Mail infringes your IP, please use the right channel so that we can act quickly.
| Type of problem | Where to read | Where to send |
|---|---|---|
| Copied books, films, music, photographs, text or software shared on Drive, Photos, a Business Profile or an ad (Indian law) | Copyright Policy | legal@indoemail.in, subject 'Copyright notice' |
| Copyright notice or counter-notice under United States law | DMCA Policy | legal@indoemail.in, subject 'Copyright notice' or 'Copyright counter-notice' |
| Misuse of a name or logo, lookalike sender names, impersonation, misleading ads or profiles | Trademark Policy | legal@indoemail.in, subject 'Trademark complaint', or abuse@indoemail.in for phishing |
| Stolen or leaked confidential information or trade secrets | This policy | legal@indoemail.in, subject 'Confidential information' |
| Misuse of Indo Mail software, design or brand by others | This policy and the Trademark Policy | legal@indoemail.in |
Please give us enough detail to find the content and show that you hold the rights. We act on valid complaints promptly, and we tell the affected user what we have done. We follow court orders. We cannot judge ownership disputes between people, and where there is a real dispute we expect the parties to resolve it or ask a court.
12. Repeat infringement
Accounts that repeatedly infringe the IP of others will be limited, suspended or closed under our enforcement ladder. Serious cases, such as running a pirate library or selling counterfeit goods through an ad or profile, may lead to closure without warning and to a report to the police.
13. Changes
We may update this policy as our products, our open-source components or the law change. We will update the open-source list when we add or remove significant components, and will mention material changes in release notes. The date at the top shows the current version.
