South African Privacy Policy

1. Responsible party

INDO CHATS PRIVATE LIMITED, 168, GT Rd, near Aloka Cinema, Shibpur, Howrah, West Bengal 711102, India, is the responsible party for personal information processed for Indo Mail accounts. Contact: privacy@indoemail.in. Our Information Officer duties are handled by the privacy team at that address; we will publish the details of a registered Information Officer when we register with the Information Regulator.

2. Conditions for lawful processing

We process personal information only where POPIA allows it: to perform our contract with you, to comply with the law, to protect the legitimate interests of you, Indo Mail or other users (for example security and spam prevention), or with your consent for optional features. We collect only what each feature needs, as listed in section 2 of our Data Protection Policy, and we never sell personal information or use mail content for advertising.

3. Special personal information and children

We do not ask for special personal information (such as religious beliefs, health or biometric information). Mail you write may contain it; we process that content only to deliver and protect your mail. Indo Mail accounts are for people aged 18 and over.

4. Transfers outside South Africa

Indo Mail stores data in Amazon Web Services' Mumbai region in India. Under section 72 of POPIA we transfer personal information there because it is necessary to provide the service you asked for, and the recipients are bound by contract to protect it to a standard substantially similar to POPIA's conditions.

5. Security safeguards

Encryption in transit and at rest, end-to-end encryption between Indo Mail accounts, access controls, activity monitoring and nightly backups, as described in the Security Whitepaper. If a security compromise affects your personal information we will tell you and the Information Regulator as POPIA requires.

6. Your rights

• Ask whether we hold your personal information and get a copy.
• Ask us to correct or delete it.
• Object to processing on reasonable grounds.
• Object to direct marketing; we do not send direct marketing without your consent.
• Lodge a complaint with the Information Regulator (inforegulator.org.za).
